1. Applicability

These terms and conditions apply to all offers, orders, agreements, workshop bookings, and deliveries by Pure Petals, unless agreed otherwise in writing. By placing an order, booking a workshop, or contacting us about our services, you agree to these terms. Any terms of the customer do not apply unless we have expressly accepted them in writing.

2. Offers and formation of agreements

Offers and quotations are non-binding unless expressly stated otherwise. Obvious mistakes, errors, or typographical errors in offers, prices, or product information are not binding on Pure Petals.

3. Prices and payment

All listed prices are in euros and include VAT unless stated otherwise. An agreement is concluded once we confirm an order or booking. Payment must be made via the offered payment method or within the agreed payment term.

4. Delivery and performance

We deliver bouquets and other products to the agreed address and within the agreed time slot where reasonably possible. Because we work with fresh and seasonal products, minor variations in color, shape, or composition may occur. Delay or force majeure does not automatically entitle you to compensation.

5. Workshops

Workshop places are only final after confirmation and, if applicable, receipt of payment. Participation is at your own risk. We reserve the right to reschedule or cancel a workshop in the event of insufficient registrations, illness, force majeure, or other compelling circumstances. In that case, we will offer a new date or refund the amount already paid.

6. Cancellation and withdrawal

For personalized or fresh products, the right of withdrawal is often excluded for consumers insofar as permitted by law. Cancellation of workshop bookings is only possible under the conditions communicated in advance during booking or confirmation. If a consumer does have a statutory right of withdrawal, we will fully respect that right.

7. Liability

Our liability is limited to direct damage that is the immediate result of an attributable failure, up to a maximum of the invoice amount or the amount paid out in the relevant case under our liability insurance. We are not liable for indirect damage, consequential damage, loss of profit, or damage caused by incorrect or incomplete information provided by the customer, unless there is intent or deliberate recklessness.

8. Complaints

Complaints about products or services must be reported as soon as possible and with a clear description by email or phone. We aim to handle complaints within a reasonable period and work towards an appropriate solution together.

9. Governing law

All agreements and these terms and conditions are governed exclusively by Dutch law. Disputes will be submitted to the competent court in the Netherlands, unless mandatory consumer law provides otherwise.
